Terms of Service

Terms governing business use of ATOM Business Platform.

Effective date: 2026-09-15


1. Agreement

These Terms govern access to and use of ATOM Business Platform (ABP), operated by DigiMarkSA. By creating or using an account, the subscribing business agrees to these Terms and any accepted order, package or commercial agreement.

2. Platform service

ABP provides lead capture, messaging, qualification, follow-up, appointment, reporting and integration features. Features and allowances depend on the selected package and configured third-party services.

3. Customer responsibilities

The customer must use ABP lawfully, keep credentials secure, obtain necessary permissions and consents for communications and personal-information processing, maintain accurate account details, and comply with Meta, WhatsApp and other connected-provider policies. ABP must not be used for unlawful, deceptive, abusive, unsolicited or prohibited communications.

4. Third-party services

ABP can depend on third-party APIs and networks. Their availability, pricing, policies, review decisions and service limits are outside ABP's direct control. The customer is responsible for any credentials or accounts it connects unless the applicable ABP package expressly provides them.

5. Fees and usage

Subscription, setup and usage charges are determined by the selected package or written agreement. Where overages are enabled, usage beyond included allowances may be charged subject to the configured limits and controls. Meta advertising spend is not included in package subscription fees. Where Meta Ads Manager is used, campaign funds are prepaid through ATOM; the ATOM Meta Ads management fee is calculated against actual Meta spend at the rate displayed/configured for the service, and unused prepaid funds remain recorded in the customer Meta wallet.

6. Availability and changes

Reasonable efforts are made to keep ABP available and secure, but uninterrupted or error-free operation is not guaranteed. Maintenance, security updates, provider changes and improvements may affect features.

7. Data and privacy

Personal information is handled according to the Privacy Policy. Each subscribing business remains responsible for its own legal obligations regarding its leads, customers, staff and communications.

8. Suspension and termination

Access may be restricted or suspended for material breach, security risk, unlawful use, non-payment where applicable, or where a connected provider requires it. Data export or deletion is subject to the agreement, retention requirements and applicable law.

9. Liability

To the extent permitted by law, ABP is provided without guarantees about business outcomes, lead conversion, third-party delivery or uninterrupted availability. Nothing in these Terms excludes liability that cannot lawfully be excluded.
